UPON the Claimant having filed a Notice of Commencement of Assessment on 13 October 2021 (the“NOC”)

AND UPON the Order of the Registrar Nour Hineidi dated 17 January 2022 dismissing the first request for a Default Costs Certificate

AND UPON the second request for a Default Costs Certificate made by the Claimant on 16 February 2022 (the“Request”) pursuant to r. 40.17 of the Rules of the DIFC Court (the“RDC”)

AND UPON the Defendant’s failure to file its Points of Dispute, pursuant to RDC r. 40.15, within 21 days from the date the Claimant served the Defendant with its NOC

AND UPON reviewing the Claimant’s affidavit of service dated 25 February 2022

AND UPON reviewing all other relevant case documents filed in this matter

IT IS HEREBY ORDERED THAT:

1. The Request is granted.

2. The Defendant is ordered to pay the Claimant a total of AED 137,528.81 (the “Amount”) within 21 days from the date of this Order.

3. In the event the Defendant does not pay the Amount within 21 days from the date of this Order, interest, pursuant to Practice Direction No. 4 of 2017 (Interest on Judgments) will accrue on the Amount from 29 March 2022 until the date of full payment.
