CONSENT ORDER


UPON the Defendant’s Application No. CFI-070-2022/1 dated 11 November 2022 seeking to contest the jurisdiction of the DIFC Courts (the “Jurisdiction Application”)

AND UPON the Order with Reasons of H.E. Deputy Chief Justice Ali Al Madhani dated 24 April 2023 dismissing the Jurisdiction Application (the “Order”)

AND UPON the parties agreeing to extend the time period in RDC 12.8(2) for the Defendant to file a further acknowledgement of service

AND UPON the Defendant consenting to the Claimant amending his Particulars of Claim dated 17 October 2022 pursuant to RDC 18.2(1)

IT IS HEREBY ORDERED BY CONSENT THAT:

1. The Defendant shall file a further acknowledgement of service by:

(a)4pm on 29 May 2023;or

(b) where the Defendant seeks permission to appeal the Order, 14 days after any order disposing of any appeal of the Order.

2. The Claimant shall file and serve his Amended Particulars of Claim by:

(a)4pm on 30 June 2023;or

(b) 28 days after filing the acknowledgement of service in 1(b) above.

3. The Defendant shall file its Defence within 28 days of service of the Amended Particulars of Claim.

4. The Claimant shall file a Reply within 21 days of service of the Defence.

5. Costs shall be costs in the case.

6. The parties shall have liberty to apply.
