AND UPON hearing Counsel for the Claimant and Counsel for the Defendant at the Case Management Conference held before H.E. Justice Nassir Al Nasser on 5 September 2024
IT IS HEREBY ORDERED THAT:
Stay of Proceedings
1. The stay of proceedings be lifted.
Agreed List of Issues
2. The parties shall agree a revised List of Issues by no later than26 September 2024.
Witness Statements (RDC Part 29)
3. Signed statements of witnesses of fact, and hearsay notices where required by the RDC shall be exchanged no later than4pm on 28 November 2024.
4. Any Witness Statement evidence in reply shall be filed and served by no later than4pm on 9 January 2025.
5. Unless otherwise ordered, Witness Statements shall stand as evidence in chief of the witness at trial.
Expert Reports (RDC Part 31)
6. If either party wishes to rely on expert evidence, it shall make an application to the Court for permission to do so by no later than28 November 2024.
7. In the event that the Court gives one or both parties permission to rely on expert evidence, the Court shall, at the Pre-Trial Review, consider what directions to give concerning a meeting and discussion between experts.
Pre-Trial Review (RDC Part 26)
8. A pre-trial review shall be listed at10am on 14 March 2025.
Trial Bundles (RDC Part 35)
9. Agreed trial bundles shall be filed and served no later than 2 weeks before trial.
Reading List and Trial Timetable (RDC Part 35)
10. An agreed reading list for trial along with an estimate of time required for reading and an estimated timetable for trial shall be filed with the Court by the Claimant no later than 2 clear days before trial.
Skeleton Argument and Chronology (RDC Part 35)
11. Skeleton Arguments and Written Opening Statements shall be filed and exchanged simultaneously 2 clear days before trial.
12. The parties shall prepare an agreed Chronology of significant events crossreferenced to significant documents, pleadings and witness statements which shall be filed with the Court by the Claimant by no later than 2 days before trial. In the event that there are areas of disagreement, the Chronology shall include an agreed Chronology and a Chronology of events which are disputed, with the parties’ respective positions outlined therein.
Trial (RDC Part 35)
13. The trial of this matter shall be listed on the first open date after 4 April 2025 with a provisional time estimate of 2 days. In the event that the time estimate for trial changes, the parties shall notify the Court at the Pre-Trial Review.
14. Costs of the Case Management Conference shall be costs in the case.
15. The parties shall have liberty to apply.
